When
doing business in another country, especially
in China, One needs to know who they are really
dealing with. Most Chinese companies have close
ties to the Chinese government, and often use
these connections to obtain contracts.
US companies need to conduct due
diligence to prevent the breaching of the US Foreign
Corruption Practice Act (USFCPA). The US Department
of Justice (DOJ), in recent years has been more
diligent about enforcing this act, regardless
of the size of the US Company.
Knowing who you
are in partnership with is probably one of the
most important factors when doing business in
China, especially if the government is involved
the project. Performing due diligence in China
is an arduous task, but not impossible.
China often at
times lacks transparency, making it difficult
to clearly see the real situation. Through experience
and contacts, we are able to help provide a clearer
picture of a potential partners' true assets and
liabilities. If your firm is not careful, it may
incur more liabilities from its partner than anticipated.
